Rule on disclosure of authority blasted (access required)

Dear Editor: I strongly dissent from Rule 3.2 of Part II of the proposed Model Rules of Professional Conduct, which will require a lawyer to disclose adverse authority if his opponent misses it. We are apparently switching from the adversarial system to something more socialistic and politically correct. This is simply one more example of rewarding the incompetent ...
