Although an ERISA plan administrator had a conflict of interest because the plan sponsor, Black & Decker,iii served in the dual role of both evaluating and paying the employee’s claims, the 4th Circuit upholds the district court’s remand to the plan to determine the appropriate code under the plan for claimant’s pseudoseizures, after the plan’s termination of disability benefits.
