Summary: An infant suffered a severe and permanent injury to the brachial plexus nerves. Plaintiff alleged that the obstetrician used excessive lateral traction after she encountered shoulder dystocia during delivery.
Plaintiff’s experts testified that a video of the delivery made by child’s father contradicted the note the defendant dictated after the delivery. Defendant withdrew a petition for rehearing after the Supreme Court of Virginia denied a petition for appeal, and the case has been resolved.
