Bagley v. EWC, LC
Type of Case: Premises liability, slip and fall
Court: Richmond Circuit Court
Attorney: David L. Epperly Jr., Richmond
Summary: A truck driver slipped and fell on ice in a parking lot. The fall aggravated a pre-existing back condition, including a calcified, herniated disk which left plaintiff permanently disabled from working.
Defendant contended that it had cleared all snow and ice from a storm that occurred two days before the fall but could present no direct evidence to support the contention. The defense also argued that the plaintiff should have recovered from the injuries within six months. The judgment has been satisfied.
