Summary: Plaintiff, an employee of a civil service arm of the Department of Defense/Navy, fell 30 feet while observing a final inspection on the repair of a fuel tank on a Navy fleet oiler. He contended that the fall was caused by his failure to observe a false rung on a ladder into the tank and that the company repairing the ship had a duty to inform him of the hazard.
Defendant contended that plaintiff was contributorily negligent and disputed its responsibility for warning of the hazard. Plaintiff suffered a mild traumatic brain injury, five fractured ribs, left elbow dislocation and aggravation of a rotator cuff tear. He incurred $117,025 in medical bills and was out of work for 18 months. The Supreme Court of Virginia denied a petition for appeal and the judgment has been paid.
