Summary: An automobile crossed double-yellow lines and crashed into a couple on a motorcycle. The 48-year-old husband and driver had an above-the-knee amputation, among other injuries, and continued to suffer from phantom pain and depression at the time of the settlement.
The 47-year-old wife and passenger had a broken collar bone, a severe laceration of her lower left leg and an injury to a tendon in her knee.
Husband’s special damages, including future medical bills and lost wages, totaled more than $1.2 million, and wife had more than $100,000 in specials. Husband’s claim settled for $4.5 million and wife’s for $500,000.
The case settled after mediation and after plaintiff’s attorneys conducted a mock trial and conducted demographic and jury research.
