Shifflet v. Electric Power Systems Inc.
Type of Case: Severe burns from electrical arc
Attorneys: L. B. Chandler Jr., Steven P. Hammond and Thomas H. Oxenham, Charlottesville
Summary: Plaintiff electrician inadvertently triggered an electrical arc flash while installing electrical switching equipment at the Middle River Regional Jail in Augusta County. His clothes caught on fire, and he incurred $690,500 in medical expenses and lost $165,000 in wages from the injuries.
Plaintiff contended that the company responsible for setting the electrical protection devices on the equipment should have set them at a level that would have resulted in a much shorter arc flash with less chance of injury.
In the bifurcated trial, settlement was reached after a jury found the defendant liable and rejected claims of contributory negligence and assumption of the risk.
