Walters and Kuffel v. City of Chesapeake

Type of Case: Traumatic brain injury, fractured legs from traffic crash

Attorneys: David D. Dickerson, P. Todd Sartwell, Virginia Beach

Summary: Two high school students, a male and his girlfriend, suffered severe injuries when a driver lost control and crossed into their lane of travel on Dominion Boulevard in Chesapeake. Plaintiffs contended that the city was responsible because it was aware of a dropoff of at least six inches from the pavement to the shoulder. They alleged that the other driver lost control when she attempted to get back on the pavement after the right tire of her car dropped from the pavement to the shoulder.

The male plaintiff suffered a concussion, broken femurs and a fractured left arm. His special damages totaled about $100,000.
The female plaintiff suffered a traumatic brain injury and a broken arm. Her special damages totaled about $300,000.

The two cases settled for a total of $4.4 million after mediation.
