Ott v. “Acme Aerial Lifts”
Type of Case: Wrongful death, industrial accident
Attorneys: Mark A. Towery, Chidi I. James, Peter S. Everett, Robert J. Stoney, Fairfax
Summary: A mechanic was killed while inspecting a boom-supported aerial lift. He fell 80 feet from the lift’s work platform when the boom became unstable and tipped over during the inspection.
Plaintiff’s attorneys blamed the instability on a design defect in a hydraulic valve that allowed the boom to descend faster than it should have. Defendant responded that mechanic was responsible for the instability of the lift because he did not conduct a function test before ascending the platform.
