Type of Case: Traumatic brain injury from application of forceps at birth

Summary: An infant suffered a traumatic brain injury when an obstetrician attempted a forceps rotation of the fetus, a procedure she had never used before. Plaintiff’s attorneys contended that the mother should have been informed of the obstetrician’s inexperience with the procedure and given an opportunity to request a cesarean section.
Special damages included $94,574 in medical bills and a future life care plan of $5.3 million because the child will never be a fully independent adult and probably will have to be placed in a group home. The case settled with the payment of $1.35 million for the child and $750,000 for the mother for emotional distress.
