Summary: Fairfax County initially offered $106,000 for the common area of a homeowners association that it needed to replace wetlands destroyed by road construction. Both sides agreed that the property had no development potential.
The landowners relied, however, on sales and leases of parkland and playing fields and argued that every landowner lost an easement when the common area was taken.
