Type of Case: Wrongful death, drowning of 5-year-old girl in fitness center pool

Attorneys: Jeffrey M. Schwaber, Ivonne C. Lindley, Rockville, Md.

Summary: A 5-year-old child drowned in a fitness center pool in Centreville. Attorneys for the child’s mother contended that the teenage lifeguards failed to observe the child and delayed searching for her in the pool after her father told them she was missing.

The attorneys also alleged that the child might have gone from the shallow end to the deep end of the pool because the rope separating the areas was not maintained or have floated into the deep end because the lifeguards did enforce a ban on flotation devices.

The defendants contended that the child’s father was responsible for monitoring her because of her age. The case was settled shortly before trial.
