Summary: Plaintiff suffered serious injuries when defendant ran a stop sign and struck the truck plaintiff was operating on behalf of his employer. Plaintiff had medical expenses of $544,000 and a workers’ compensation lien of more than $600,000.
Defendant had only $50,000 in coverage, but plaintiff had $100,000 in underinsured coverage on his own vehicle, and the company truck had a $1 million umbrella policy.
The workers’ comp carrier reduced its lien by $300,000 because of the severity of plaintiff’s injuries – fractures of femur, pelvis, clavicle, ankle; urologic dysfunction; permanent right foot drop; and memory impairment.
