Type of Case: Closed fractures to neck, internal injuries and separated shoulder in intersection crash between pickup truck and tractor-trailer.

Summary: Plaintiff was a passenger in a pickup truck that was hit by a tractor-trailer when the driver attempted to cross a four-lane divided highway. The driver of the pickup was killed, and the case was resolved with $50,000, the maximum available from the driver’s carrier, $350,000 from two underinsured motorists policies of the plaintiff and $600,000 from the carrier of a construction company that was working on the highway.
Plaintiff contended that an employee of the company “waved” the driver into the intersection.
