The office of Sen. Kay Hagan, D-N.C., now says she misspoke when she said Wednesday that she had recommended three candidates to President Obama for appointment to the 4th U.S. Circuit Court of Appeals.
Her spokesman says she’s actually discussing several possibilities with White House counsel and no formal short list has been presented.
Hagan’s statement was part of a flurry of activity this week about appointments to the 4th Circuit, where four of 15 seats are vacant.
Virginia Senators Jim Webb and Mark Warner recommended Virginia Supreme Court Justice Barbara Milano Keenan for one of those vacancies, and the Senate Judiciary Committee recommended on a 17-3 vote confirmation of Obama’s choice for another seat, U.S. District Judge Andre M. Davis from Baltimore.
