Battlefield preservationists lack standing, county says

The Orange County Board of Supervisors says the lawsuit seeking to block construction of a Walmart in a historic battlefield area is no more than a policy disagreement and should be dismissed.

The lawsuit, filed Sept. 25, claims that supervisors disregarded concerns about the negative impacts the store would have on the battlefield and park, reports The Free Lance-Star.

In its response, the county argues that neither the federal nor state government has prohibited commercial development on the privately owned property, and that the lawsuit stems from a fundamental policy disagreement and fails to state a clear cause of action.

The court has not yet set a hearing date for the case.
