In a brief filed today, the commonwealth urges the 4th U.S. Circuit Court of Appeals to affirm a ruling overturning a key element of the Obama health care law.

The Justice Department is appealing the December ruling by U.S. District Judge Henry Hudson that the health care plan’s “individual mandate” is unconstitutional.
Arguments are scheduled for May 10 and a ruling from the 4th Circuit could come in July.
