May trial set on Albemarle County removal petition

CHARLOTTESVILLE (AP) A May 20 trial is set on a petition seeking the removal of an Albemarle County official who pleaded guilty to sexual battery.

Earl Smith of Keene submitted the petition to the circuit clerk’s office last week. Smith contends that Supervisor Christopher Dumler’s conviction on the misdemeanor charge is hampering his ability to serve.

Media outlets report that Albemarle County Circuit Court Judge Paul M. Peatross set the date for the bench trial last Tuesday.
Lynchburg Commonwealth’s Attorney Michael Doucette is serving as special prosecutor for the case.

Dumler pleaded guilty in January. He has said he won’t resign but he won’t seek re-election. His term ends in 2015.

Dumler and his attorney declined comment following Tuesday’s hearing.
