Anthony Juniper was sentenced to death for the 2004 murders of ex-girlfriend Keisha Stevens, her two children and her brother, Ruben Harrison III.
The 4th U.S. Circuit Court of Appeals ruled Tuesday that Juniper is entitled to appointment of a new lawyer to review his claim that he was denied effective representation at trial, according to The Virginian-Pilot. A federal judge in March had rejected that claim made in a federal habeas petition.
Juniper came within one day of being executed in 2011 when a judge stayed the execution to allow him to pursue federal appeals.
