Trial set for lawyer accused of assault on deputy

Trial has been set June 16 for a Portsmouth lawyer accused of assaulting a deputy at the Portsmouth courthouse last fall, the clerk’s office reports.

Sterling Weaver is charged with felony assault and battery of a law enforcement officer and misdemeanor sexual battery in the Oct. 25 incident.

Retired Prince William County Circuit Judge William D. Hamblen has been appointed to hear the case, according to the clerk’s office.

Virginia Beach Assistant Commonwealth’s Attorney Michael DeFricke will serve as special prosecutor, according to that office. Virginia Beach lawyer Thomas Shuttleworth represents Weaver, according to the clerk’s office.

Weaver was acquitted of a 2006 charge that he grabbed the throat of a Chesapeake prosecutor after she told him she needed to postpone a case.
