He may have been on the winning side in the lower courts, but Virginia Attorney General Mark R. Herring is asking for the U.S. Supreme Court to review the case involving Virginia’s ban on same-sex marriage.
Herring hopes the high court will use the Virginia case to invalidate gay marriage bans nationwide. “The nation looks to this Court to answer the question presented here,” Herring wrote in the state’s petition for writ of certiorari.
Prince William County Circuit Court Clerk Michèle McQuigg, who supports the gay marriage ban, has said she also intends to ask for U.S. Supreme Court action on the case. By filing now, Herring said, the state may enable the court to consider the case more quickly.
