Judicial Council seeks input on appellate rules of court

The Judicial Council of Virginia is asking for formal comment on proposed changes in the appellate rules of court developed over three years by a committee chaired by Supreme Court Justice Donald W. Lemons.

The amendments are an effort to “promote clarity, conciseness and uniformity in the rules” of the Supreme Court of Virginia and the Virginia Court of Appeals, Lemons said. The changes would affect Part 5, which applies to the Supreme Court, and Part 5A, which governs procedures for the court of appeals.

Comments should be sent to Steven Dalle Mura, Director of the Department of Legal Research, Office of the Executive Secretary, Supreme Court of Virginia, 100 N. Ninth St., Richmond, VA 23219.

The deadline for comments on Rule 5:9, which pertains to the notice of appeal is Oct. 10. The deadline for comments on other proposed changes is Oct. 31.

The report of the Appellate Rules Advisory Committee is available on the Supreme Court Web site, www.courts.stateva.us/scv/home.html, under the heading “Amendments to the Rules of Court.”
