The decedent was a 6-year-old boy who died as a result of head trauma sustained when the defendant ran a red light. The unique aspect of this case was that the decedent had terminal brain cancer at the time of the accident.
The pediatric oncologist at VCU Medical Center opined that he probably only had an expected life span of two to four more months just prior to the car accident. He was being driven by his mother to a doctor’s appointment when the accident occurred.
The beneficiaries were his mother, a Hispanic immigrant; his father, who was in jail at the time of the accident; and his 5-year-old sister. The sister’s share of the proceeds was structured.
