It is problematic that hyperlinks to outside documents, such as official government reports, are NOT allowed under Rule 1.17(d)(10) --

(10) Hyperlinks between two portions of a filed document or between two or more documents filed in the same case, are permissible, but hyperlinks to other documents, or to external websites, are prohibited. A hyperlink is not itself a part of the official filed document and each hyperlink must contain a text reference to the target of the link.

There is an easy solution to this problem: Request Oral Argument. While it is true that the Court denys many writs for procedural reasons, if the petition is considered on the merits, the appellant has the right to appear before a panel of the Justices -- thus, the appellant will know which Justices (and usually a Senior Justice) denied the appeal. Even where oral argument is not allowed or waived, the appellant can request a rehearing that will be considered by all the active members of the Court -- and if it is refefused, the appellant will then clearly know which Justices refused the appeal - - - ALL OF THEM!

(That organization's Web site does not spell out the details, stating only, "The HBA-VA once again participated in judicial evaluations, providing advice and recommendations to U.S. and Virginia Senators with respect to judicial candidates for positions on the U.S. District Court for the Eastern and Western Districts of Virginia. After interviewing the candidates, in conjuction with other minority Bars, detailed reviews and written recommendations were made to assist the committee in the selection process.")

The headline and article mention that the Hispanic Bar Association of Virginia completed its evaluation, but then omits that group's conclusions. (I'll watch for an update.)
