The Virginia Court of Appeals will hear arguments next month in the case of a man seeking release from prison based on new testimony from his co-defendant.
Dustin Turner, a former Navy SEAL trainee, has been serving an 82-year prison sentence for murder in the 1995 killing of Jennifer Evans outside a Virginia Beach nightclub, according to the Richmond Times-Dispatch. His co-defendant, Billy Joe Brown, is serving a 72-year term for the same crime. When they were arrested, each man accused the other of being the killer.
Brown has since confessed to killing a young woman by himself.
The appeals court has set oral arguments for April 14.
