The Workers’ Compensation Commission has decided to extend the time allowed to file appellate written statements with the commission, from 15 days for appellant, with 10 more for appellee, to 30 days and an additional 15 days.
Litigants routinely request extra time for briefing, often because they’re pursuing settlement, according to Chief Deputy Commissioner James J. Szablewicz. By building more time into the regular briefing schedule, the commission hopes to skip the administrative step of considering and ruling on requests for additional time.
The commission adopted the change, which did not require a formal amendment to commission rules, at its regular administrative meeting held yesterday. The change is effective with the briefing cycles that begin next week, Feb. 23, Szablewicz said.
