A special prosecutor will be appointed in a Suffolk bank robbery case because Commonwealth’s Attorney Phil Ferguson is on the board of directors of the victim bank.
Jim Grandfield, the public defender representing one of the suspects, alerted Circuit Court Judge Rodham Delk after learning of Ferguson’s connection to the bank, reports The Virginian-Pilot.
Ferguson’s own investigator had also been the first on the scene of the crime after the bank manager learned of the robbery.
Assistant Commonwealth’s Attorney Susan Walton argued for the case to stay in Suffolk, claiming the situation was not an ethical violation.
Judge Delk, however, disagreed and ordered that the case be prosecuted by someone outside of the city.
