UIM carrier contributes to settlement in crash – $220,000 Settlement

The plaintiff, a 46-year-old female who worked for a local insurance agency, was involved in a Feb. 9, 2007, motor vehicle collision on Smith Station Road in Spotsylvania County. The defendant crossed the double solid yellow lines and struck the plaintiff head on.

As a result of the collision, the plaintiff sustained a right distal fibula fracture with an incomplete dislocation of the ankle, as well as a right knee laceration and chest-wall contusion. The right ankle fracture required an open reduction internal

fixation surgical procedure 10 days following the crash. Nine months later she underwent an arthroscopic debridement of scar tissue in the right ankle.

Medical specials totaled $35,764.14. The defendant carrier paid its policy limits of $100,000 and the plaintiff’s UIM carrier contributed $120,000.
