Plaintiff was injured in a head-on collision on River Road in Goochland County on Feb. 13, 2009. The defendant crossed the double yellow line and struck the plaintiff’s vehicle in her lane of travel. The defendant died in the wreck. It was alleged she may have died immediately prior to crash.
Plaintiff was transported to Virginia Commonwealth University Medical Center and remained hospitalized initially for four days. Dr. Gregory Domson performed surgery to repair her left tibial plateau fracture on Feb. 14. Plaintiff returned to VCU Medical Center for surgery to repair her right foot Lisfrane fracture later in the month. Dr. Robert Adelaar performed her second surgery which required an overnight stay.
Five months later, the plaintiff required a third surgery to remove hardware from her foot and to remove adhesions to a tendon. Dr. Jan Esway of West End Orthopeaedic Clinic carried out this final procedure.
Settlement was reached with a slight discount of the policy limits.[10-T-070]
