The plaintiff was riding a Harley-Davidson motorcycle when he was hit broadside by a car coming out of a side street. He was flown by helicopter to Fairfax Inova Hospital where he underwent surgery for fractured/splintered femur and a rod was implanted. He had several other surgeries for skin grafting and for repair of a dislocated shoulder.
Plaintiff was left with one leg slightly shorter than the other and with significant scarring of his leg and shoulder. He did not lose any income in that his salary as a computer incident response coordinator (supervisor) was continued; he was consulted by phone as his condition permitted.
The Aetna health insurance ERISA lien was settled at a significant discount.
