Rules of Evidence posted

The Supreme Court of Virginia has posted the new Rules of Evidence online as a 27-page PDF file.

The Virginia Rules of Evidence, approved in a stormy legislative session, take effect July 1. Because the rules reflect an effort to simply state existing Virginia law, no major change in practice is anticipated.

An official set of evidence rules had been a goal of various lawyers and judges for 18 years. Chief Justice Cynthia Kinser breathed new life into the project last fall by suggesting presentation of a proposed set of rules to the state Code Commission.

It appears the evidence rules are designed to take the place of the now-repealed rules of equity as “Part Two” of the Rules of Supreme Court of Virginia.

  1. The Fairfax Bar Association will be offering a Primer CLE on the Codified Rules on June 28, 2012, which will also be available by video about a month thereafter. Here is a link to the program which will include materials such as the source caselaw for each rule and a rule-by-rule comparison with the Federal Rules:
