On Feb. 18, 2012, plaintiff was rear-ended on Route 522 in Rappahannock County. He was slowing to make a right turn into a friend’s driveway when a 1986 International tractor-trailer, driven by the defendant, struck the rear of his 1998 Ford Ranger pickup truck. The investigating state trooper charged defendant with reckless driving.
Plaintiff was transported from the scene to Culpeper Regional Hospital, where he remained for approximately two weeks. He underwent surgery with internal fixation of the right tibial fracture. The plaintiff sustained a foot drop.
Mediation was carried out shortly after filing suit and before service of process was obtained. The case settled a few days after mediation.
