Title insurer claims lawyer misappropriated millions

City_of_Virginia_Beach_SealA Virginia Beach lawyer has been sued by a title insurance company that claims he misappropriated nearly $2.3 million from funds that were supposed to be held in escrow accounts.

The insurer is asking for levies on various accounts controlled by lawyer David Flynn, according to a report in Inside Business.

The lawsuit in Virginia Beach Circuit Court was filed by California-based First American Title Insurance Co. It names Flynn’s law firm, David R. Flynn PLLC, and his limited liability company, Assured Title of Virginia.

The company alleges Flynn failed to properly maintain separate escrow accounts for real estate closings and pay deeds of trust from the proceeds of real estate closings.

First American asks that a judge levy on five of Flynn’s bank accounts and all books and records at Flynn’s firm.

Flynn is being sued separately over a management contract for a tanning business he owns, the paper reported.
