Plaintiff was riding his 2005 Harley-Davidson motorcycle on June 20, 2012, when he was struck by a large sport utility vehicle. The wreck happened on Bell Creek Road in Hanover County. Defendant, the driver of the SUV, was attempting to turn right onto Bell Creek Road from a shopping center parking lot when she struck plaintiff as he traveled in the left-hand lane. Defendant admitted she did not see the plaintiff. The investigating deputy charged defendant with failure to yield the right-of-way. Defendant pled not guilty but was convicted. She allegedly stated that the accident was all her fault, but later on claimed that the plaintiff was intoxicated and claimed he was racing with a friend after leaving Buffalo Wild Wings restaurant. Plaintiff blew a .16 at VCU Medical Center, but he denied drinking heavily before the accident and believes the blood alcohol content was affected by the medication he was given initially. Plaintiff was a convicted felon, but a long-time employee of Henrico County. He made a good recovery from his injuries. He was receiving no ongoing medical care, and had returned to full duty at work.
