Excessive force case headed for trial

A federal judge has denied summary judgment for Roanoke jailers accused of beating an inmate and causing a severe head injury.

The ruling means the claim of Oneal Scales against three jail staffers can go to trial.

U.S. District Judge Glen E. Conrad viewed surveillance video from the Roanoke jail that, he said, could support Scales’ claim that he backed away after a 2011 encounter with an officer at his cell door.

Scales alleged he was beaten in the cell by one officer while being restrained by two others. Scales’ version of the incident was “not clearly contradicted by the video footage,” Conrad said.

Scales reportedly suffered a subdural hematoma. He seeks $10 million in his civil rights lawsuit.
