Injured pedestrian settled with insurers before suit was filed – $200,000 Settlement

Plaintiff is a 63-year-old female who was crossing the street when she was struck by a vehicle. She fractured her tibia and underwent a successful surgery. Defendant driver claimed the sun was in her eyes and that she did not see the plaintiff. Defendant also argued that the plaintiff did not see her before impact, and that there was contributory negligence. The investigating officer did not charge the defendant. Defendant’s carrier tendered the limits of $50,000, and

plaintiff’s UIM carrier contributed $150,000 for a total settlement of $200,000. The case was settled between plaintiff’s counsel and the insurance companies before suit was filed.
