TV fell on toddler at daycare center – $290,000 Settlement

Plaintiff, a 2-year-old, was at a religiously exempt daycare when he attempted to climb a metal TV cart in the room he was supposedly being watching in, causing the cart and an old fashioned CRT television to fall directly onto his torso. There was a video of the incident, showing only one daycare worker present, who was attending other children at the time of the injury.

After the incident, plaintiff was taken to the hos­pital by EMS. Plaintiff was diagnosed with a right femur spiral fracture, resulting in $16,000 worth in medical bills. The plaintiff made a good recovery with no permanent impairment or future medical expens­es expected.

None of the employees involved in this accident are still employed by the daycare facility. Retired Judge Diane McQ. Strickland mediated the case. The case settled for $290,000.
