Plaintiff, a 2-year-old, was at a religiously exempt daycare when he attempted to climb a metal TV cart in the room he was supposedly being watching in, causing the cart and an old fashioned CRT television to fall directly onto his torso. There was a video of the incident, showing only one daycare worker present, who was attending other children at the time of the injury.
After the incident, plaintiff was taken to the hospital by EMS. Plaintiff was diagnosed with a right femur spiral fracture, resulting in $16,000 worth in medical bills. The plaintiff made a good recovery with no permanent impairment or future medical expenses expected.
None of the employees involved in this accident are still employed by the daycare facility. Retired Judge Diane McQ. Strickland mediated the case. The case settled for $290,000.
