A family lost its mother, father and grandmother in a head-on collision with a tractor-trailer. The driver was alleged to have lost control in rainy conditions on a downhill grade killing all instantly. The driver consistently denied his negligence. There were no witnesses.
The father headed a community medical practice and the mother was a retired schoolteacher. The grandmother had a longtime career in government service. The case settled for policy limits. A forensic analysis conducted by a CPA of the financial strength of the defendant small trucking company revealed no assets to satisfy excess verdicts. There were six beneficiaries – all young adults. Two of the beneficiaries chose to structure a portion of their net proceeds with the assistance of Ron Feinman of One World Structured Settlement Design. The cases were settled after the exchange of written discovery.
