While the plaintiff was filling the oil tank with his vehicle parked in the driveway, the homeowner and defendant Catron attempted to leave the property in his vehicle. The defendant failed to see the plaintiff and backed his vehicle into the oil truck pinning the plaintiff between the two vehicles, crushing plaintiff’s lower extremities.
