Student thrown from car in wreck on drive home for summer – $450,000 settlement

Plaintiff, a Tidewater peninsula resident, was a passenger driving home from college for summer break when the host driver lost control in South Carolina on Interstate 95. Plaintiff was ejected and suffered a clavicle fracture. Plaintiff needed emergency flight medical transport and emergency surgery in South Carolina. Plaintiff recovered well but still suffers from anxiety from the incident and needs additional removal surgery for the mobilizing hardware.

The case was difficult as the parties were romantically involved during the majority of the litigation and living together at the time. The total coverage was $500,000 under the defendant’s parent’s policy.
