Nominating deadline extended due to COVID-19 orders

Virginia Lawyers Weekly//May 14, 2020

Where Code § 24.2-510 requires political committees to complete their nominations by the second Tuesday in June, and executive orders issued in response to the COVID-19 pandemic make it unlikely that plaintiff can hold a timely nominating convention, the court grants a temporary injunction that enjoins the Virginia Department of Election from enforcing the statute.

The injunction is in effect until 7 p.m., July 28, 2020. Plaintiff must make “all best efforts to arrange for and conduct a convention to select its nominee for Congress as soon as practicable and safe before the termination of this Court’s temporary injunction.”

The court retains jurisdiction over this matter.

Seventh Congressional District Republican Committee v. Virginia Dep’t of Elections, et al., Case No. CL-20001640-00. (Order) April 14, 2020; Richmond City Cir. Ct. (Cavedo). VLW 020-8-049, 7 pp.
