Description of case: Defendant driver turned left without warning on a yellow light into the path of oncoming traffic at an intersection in Albemarle County. Plaintiff was lawfully traveling in a through lane into the intersection at or about the speed limit of 40 miles per hour. Plaintiff was unable to avoid the collision with defendant’s vehicle in the intersection and struck the corner of defendant’s bumper, sending plaintiff’s car off the road and into a telephone pole.

As a result of the crash, plaintiff sustained displaced rib fractures to ribs 4-7 on the right side and a displaced fracture to his sternum. Plaintiff was 57 years old at the time of the crash and previously had received a kidney transplant, complicating his medical management during his nine-day hospitalization for his injuries from the crash.

Plaintiff was unable to return to work as a firefighter for six months following the crash due to his injuries.
