Description of case: A 30-year-old , six-year Army/Afghanistan veteran and father of two children lost control of his motorcycle in Greene County and fell into the roadway. He was attended to by two passersby who attempted to alert oncoming traffic until paramedics could arrive. The defendant disregarded the warnings of the witnesses, drove through the accident area and ran over the victim’s body, thereby killing him.
The defendant had minimum liability coverage in the amount of $25,000 and an asset search proved to be unproductive. The victim had underinsured motorist coverage that totaled $500,000.
There was preliminary protest by the underinsured carrier based upon its theory that the victim might have been operating his motorcycle intoxicated and dead before he was hit by the defendant. Once the witnesses were located, however, it became clear the defendant was liable.
The entire insurance proceeds were paid into structured settlements for the surviving children.
