Description of case: On Dec. 11, 2020, the plaintiff, a 48-year-old female, was being transported to a medical appointment in a wheelchair. She was a paraplegic from a spinal cord injury which occurred as a teenager in a swimming pool accident. The plaintiff claims that the defendant medical transportation company’s driver slammed on the brakes suddenly while traveling too rapidly, causing her to slip out of her wheelchair. The driver denied all negligence. There was no police investigation and no independent witnesses to the incident. The plaintiff continued on to her prearranged medical visit and was then transported to VCU Medical Center for treatment for her orthopedic injuries.
