Description of case: On June 22, 2019, on the Virginia Beach Oceanfront, Kalvinn Gorski was struck by an electric Bird scooter. Kalvinn, who was 5 years old at the time, was riding his kick Razor scooter on the boardwalk when he was struck by the defendant, who lost control of his scooter. The Bird scooter flew up and struck Kalvinn in the head. The injury was investigated by the Virginia Beach Police Department.

The plaintiff was treated at both Sentara Virginia Beach General Hospital and at Children’s Hospital of The King’s Daughters before returning to North Carolina, where he followed up for additional medical care.

Coverage was provided through the defendant’s mother’s homeowners policy and the defendant’s auto insurance coverage. The plaintiff made a good recovery.
