Description of case: The paintiff was traveling eastbound on Minnieville Lane attempting to proceed straight through the intersection with Canton Hill Road. The plaintiff was stopped at a red traffic signal and, as the light turned green, started to move and was rear-ended by a Mack waste collection truck. Plaintiff was extricated from his vehicle and flown by helicopter to INOVA Fairfax Hospital.

Initially, he was diagnosed with a concussion and left arm fracture. CT head scans appeared normal. Several weeks later, plaintiff began experiencing extreme dizziness and confusion. He presented to Virginia Hospital Center and a subsequent head CT scan was performed which revealed a subdural hematoma. He then was transported to Georgetown University Hospital for an emergency craniotomy.
