A Richmond Circuit Court has no subject matter jurisdiction to hear these two appeals from general district court orders imposing sanctions in these matters arising from warrants in debt.
These two cases are appeals from GDC orders granting sanctions under Va. Code § 8.01-271.1. The motions emanate from underlying cases consolidated for trial involving several warrants in debt. Defendants in those actions filed motions for sanctions, and plaintiffs responded with their own motions for sanctions. The GDC held a trial on the merits of the case and entered a final order. Later, the court held a hearing on the remaining issue of sanctions, and entered an order granting sanctions adverse to Louise Moore and William Grogan.

Virginia law provides a right to appeal of “any order entered or judgment rendered” from the GDC to the circuit court. The Virginia Supreme Court has determined that this language provides for an appeal only from final orders or judgments. A final order or judgment is one that disposes of the whole subject of the case and gives all relief contemplated. The final order in this case disposed of all relief prayed for, including attorney’s fees. The orders appealed determining sanctions was an ancillary matter that only awarded attorney’s fees incurred as a sanction. The appeal is based solely upon the determination of sanctions. This court lacks jurisdiction to rule on the sanctions alone, and could only reach the issue if it followed in due course from a trial de novo on the merits of the case. Both appeals are denied for lack of subject matter jurisdiction.
