Case description: The defendant’s corporate vehicle turned left in front of the plaintiff’s vehicle in early 2023, causing a T-bone collision. The plaintiff, a woman in her 30s, was airlifted from the scene and diagnosed with soft tissue injuries to her head and neck, back, shoulders, arms, chest, hips and legs, with bruising to her pelvic region.
Pain persisted in the plaintiff’s back and by the time of settlement, she had been enrolled in pain management for approximately a year. Her provider recommended a future Intracept procedure as well as courses of physical therapy, massage and acupuncture, given that she was not a surgical candidate. During her back treatment, she continued to complain of urinary incontinence. Relationship between the back injury and the incontinence was ruled out before she was finally diagnosed with a pelvic floor injury approximately two-and-a-half years after the collision. She underwent a pelvic floor surgery in January 2026 and due to complications, had emergency surgery performed immediately thereafter. The defense contested causation of damages for the back and pelvic floor injuries, citing the fact that she had multiple pregnancies and prior pelvic issues, including a hysterectomy and incontinence.
Medical experts opined that the plaintiff’s back injury was permanent. Plaintiff underwent pelvic floor surgery, including robotic sacrocolpopexy, enterocele and rectocele repairs, a transobturator sling, cystoscopy and overlapping anal sphincteroplasty. She developed complications and underwent additional surgery, including midline laparotomy, extensive adhesiolysis and explant of sacrocolpopexy mesh.
