Case description: The plaintiff was traveling on his motorcycle in the right lane when the defendant driver veered across two lanes of travel in an attempt to make an exit off the highway. The defendant’s car collided with the plaintiff’s vehicle, throwing him from his motorcycle onto the pavement. The plaintiff was taken by ambulance to an emergency room where he was treated for two broken wrists and severe road rash.
Liability was initially disputed but eventually the liability carrier (Allstate) tendered its $30,000 limits and the plaintiff’s UIM carrier (also Allstate) tendered its $50,000 limits. After extensive negotiations, the plaintiff’s mother’s UIM carrier (Amica) and the plaintiff’s father’s UIM carrier (GEICO) tendered a combined $450,000 for a total settlement of $530,000.
