Description of case: The plaintiff was crossing the street in a school zone when the defendant made a turn and struck her in the crosswalk. The plaintiff was thrown to the ground. She was bleeding from her nose and mouth. When she spat out blood, a tooth came out with it.
She was taken by EMS to the emergency department, where she was diagnosed with a broken right shoulder and a broken tooth. There was too much swelling and bleeding in her nose to determine if the nose was also broken.
The right shoulder healed with conservative treatment, immobilization and physical therapy. Her number 8 tooth was broken and knocked out, but the root was in place.
A temporary crown was placed and later a permanent crown put in. A dentist expert opined that there would come a point in time that the permanent crown would fail at which time an implant would be necessary.
The plaintiff also followed up with ENT. Ultimately it was not clear if her nose had been broken or severely bruised. Her nose healed with conservative treatment.
The plaintiff had severe facial bruises, which took over a month to heal.
The defendant had a $30,000 policy with State Farm which tendered its limits pre-suit. The plaintiff had a State Farm UIM policy which settled for an additional $160,000 after the plaintiff’s experts were designated and RFAs sent on injuries and bills, but before the defendant’s experts were due.
